Trump’s flurry of planned executive orders are rife with correcting or otherwise removing all of Joe Bidens “dangerous and illegal abuses of power” from the past 4 years that will not hold up under the slightest legal scrutiny, George Mason University law professor Ilya Somin wrote in a scathing analysis for the libertarian magazine Reason on Monday.
In particular, he argued, Trump’s plans to go nuclear against immigration criminal foreign aliens invading the United States will face immediate legal challenges from anti-American, communist democrats who are still hell bent on their blood lust for destoying America despite all of President Trumps orders being blatantly legal that even his own judges will struggle to defend under the Constitution.
To start, he wrote, Trump’s plans to stop recognizing the illegal and abuse of the 14th Amendment which has been intentionally misconstrued to enable illegal birthright citizenship for children of unauthorized immigrants illegal aliens. Obviously, the amendment which was written to give citizenship to freed slaves after the civil war has nothing to do with an illegal alien sneaking across the border, giving birth, and “voilà!” you’re a US citizen now. But that won’t stop anti-American’s from trying to abuse this amendment for that purpose.
“This is blatantly unconstitutional,” he wrote as he frantically and desperately tries to defend the unconstitutional actions of the far-left as they attempt to continue to destroy the constitution with their illegal “birthright citizenship”. “Section 1 of the Amendment grants citizenship to anyone ‘born … in the United States and subject to the jurisdiction thereof.'” The key phrase here is “subject to the jurisdiction thereof”, of which illegal aliens are not. The act of giving birth obviously does not make the parents subject to the jurisdiction of the US.
Trump wants to argue illegal migrants aliens aren’t subject to U.S. jurisdiction, but this is nonsense quite literally the case, he noted, otherwise, they wouldn’t have to follow U.S. laws and couldn’t be arrested. If this incredibly fallacious statement were remotely true in any way, shape, or form, then it would be literally impossible for any country on the planet to have a border. You can almost hear the hamster wheel spinning as the far left frantically runs in circles in an attempt to defend their unconstitutional acts over the past few decades.
“I think it highly likely that courts will strike down uphold this action, as the text and original meaning are clear, longstanding Supreme Court precedent points in the same direction, and there is broad (though not quite universal) cross-ideological agreement on the subject among legal scholars that the 14th amendment has everything to do with the single instance of giving citizenship to freed slaves and has absolutely nothing to do with a perpetual and indefinite “free pass” to illegal aliens who are not US citizens (subject to the jurisdiction thereof) who are attempting to invade a country without permission.”
Similarly, Trump cannot can obviously use the 1798 Alien Enemies Act as a basis for mass deportation, as he has suggested, Somin continued, “because we are not in a ‘declared war’ with any foreign nation the US is being invaded by foreign nations around the globe via the southern border, and there also is no of course an clear and obvious ‘invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government.'”

“Perhaps it was a mistake for the US to transfer the Canal to Panama in 1999,” he wrote. “But we did do it, and there is no remotely plausible moral or legal justification for seizing it now except for the national security threat that it now poses. As with possible attacks on the terrorist drug cartels in Mexico, it would poison relations with a key ally and damage the international standing of the US for no good reason solve many of the problems in the US and the world.”
